This document outlines the Terms and Conditions (the "Agreement") for the use of services provided by The Cherenfant Group ("TCG"). By engaging with our services, the client ("Client") agrees to be bound by these terms.

Services Provided

The Cherenfant Group provides personal and business coaching to help organizations scale and fuel professional growth through the power of trust. Our coaching services focus on the following key areas:

Increased Self-Awareness and Positive Mindset

Our business coaching helps clients develop self-awareness by identifying their strengths and weaknesses. The goal is to help you feel more in control of your processes and develop a positive mindset that leads to success.

Clarity on Success and the Steps to Achieve It

TCG coaches have succeeded in their own ventures and can model what success looks like and how they got there. We will work with you to define what success means for your unique business goals and help you create a clear roadmap to achieve it.

Improved Performance, Productivity, and Confidence

Our business coaching is designed to help you improve your overall performance, productivity, and confidence by developing:

* Self-awareness and a positive mindset.

* The skills needed to make valuable business decisions.

* Accountability for your processes and the ability to recognize where change is necessary.

Cancellation and Refunds

7-Day Money-Back Guarantee

We offer a seven-day money-back guarantee. To be eligible for a refund, you must submit a cancellation request via email to andy@cherenfantgroup.com within seven days of your purchase date.

Refund Policy

* Cancellation requests must be submitted before the eighth day to be eligible for a refund.

* Refunds will not be provided for partially used services or if the Client does not follow the written and coached plan.

* Upon requesting to cancel your service, your access will end immediately.

* The email for cancellations, andy@cherenfantgroup.com, is monitored Monday through Friday from 9 a.m. to 5 p.m. Eastern Time. Any request received after 5 p.m. will be acknowledged on the next business day.

Dispute Resolution and Legal Terms

Governing Law

This Agreement is governed by and construed under the laws of the State of Florida.

Waiver of Chargeback Rights

The Client waives any right to dispute, charge back, or reverse payments once they are made. Any disputes must be handled in accordance with the dispute resolution terms outlined by TCG. By signing this Agreement, the Client explicitly acknowledges and waives the right to initiate any chargebacks, disputes, or payment reversals for payments made to The Cherenfant Group.

Chargeback Consequences

In the event of a chargeback, the Company will pursue legal action to recover funds and seek damages. This may result in the immediate suspension of all services connected to The Cherenfant Group and The Cherenfant Group Inc., including third-party vendors and advisors. The Client will be held liable for the breach of this Agreement, including all legal fees and costs associated with the chargeback dispute.

Credit Reporting and Collections

The Client’s account may be reported to a credit agency, and the chargeback will be recorded as unpaid debt, which may negatively impact the Client’s personal and business credit profile. The Company reserves the right to engage third-party collection agencies to recover the disputed amount along with any fees incurred during the recovery process.

Evidence for Resolution

TCG will provide irrefutable evidence to contest any chargeback claim, including but not limited to:

* A copy of the signed Agreement, detailing the Client’s acknowledgment and acceptance of these terms.

* Payment confirmations, details of services rendered, and communications via email, phone, and recorded meetings.

* Deliverables sent to the Client.

Arbitration Requirement

The Client agrees that any payment disputes must first be resolved through the resolution and arbitration process outlined in this Agreement. Initiating a chargeback without following this process constitutes a breach of contract.

Binding Nature of the Agreement

The Client agrees that this Agreement is legally binding and enforceable in the event of a chargeback or payment dispute. The terms will be presented as evidence to any payment processor, arbitration panel, or court of law to demonstrate the Client’s acknowledgement and acceptance of these terms.

Suspension for Nonpayment

If TCG is unable to process a Client’s payment for three separate billing cycles, the payment plan will be terminated. The full balance of the Program Fee, along with any collection, cancellation, and legal fees, will be due immediately. Declined payments do not relieve the Client of the obligation to pay the full Program Fee. Failure to pay within four days of the due date will cause the Client to lose "good standing" and may result in the loss of access to program benefits, retreats, or other TCG offerings.

Coach Availability

While TCG strives to maintain availability for scheduled sessions, occasional adjustments may be necessary. The coach and/or TCG team will provide advance notice and reschedule sessions as needed.

Confidentiality and Privacy

All information shared during coaching sessions is confidential and intended solely for the coach and the Client. Both parties agree not to disclose any confidential information without explicit consent.

To protect the integrity and trust within the TCG community, all clients agree not to solicit, pitch, or offer any products or services to fellow clients or affiliates of TCG without prior written consent from The Cherenfant Group.

Violation of this clause, whether through private messages, group chats, in-person events, or any other means, is a direct violation of these Terms and Conditions. This will result in immediate removal from all TCG programs without a refund. The violator may be held financially responsible for any damages, and TCG reserves the right to pursue legal remedies, including claims for loss of business, reputational damage, and interference with contractual relationships.

Termination of Service

The Cherenfant Group reserves the right to terminate a Client's service without a refund in cases of a violation of these terms, misconduct, or a breach of confidentiality. The Cherenfant Group does not tolerate threats, degrading, discriminatory, or hostile communication. Any Client who engages in or supports such conduct will be terminated immediately and banned from all future services from The Cherenfant Group and The Cherenfant Group Inc.

Limitation of Liability

While TCG provides guidance and support, we shall not be held liable for a Client's decisions or actions based on the advice received during coaching sessions. TCG will not be held responsible for any partnerships or agreements made with other clients or consultants.

Changes to Terms and Conditions

These terms and conditions may be updated or modified at the discretion of The Cherenfant Group. Clients will be notified via email of any changes, and the continued use of our service will constitute acceptance of the updated terms.
